What Happens If the Auction Is Cancelled?
A bank vehicle auction can sometimes be cancelled, postponed, or withdrawn by the bank or authorized seller. What happens next depends on the auction notice and the stage at which the cancellation occurs.
1. Auction May Be Cancelled Before Bidding
A bank may cancel or postpone an auction before the bidding process is completed. Some SBI auction terms expressly reserve the right to postpone or cancel an auction.
In this situation, bidders should check the notice or contact the authorized officer for the next auction date.
2. What Happens to the EMD?
If the auction fails or is cancelled, the EMD may be refunded according to the auction terms.
For example, SBI terms for an e-auction state that EMD of unsuccessful bidders is refundable. In an MSTC-based process, the refund may require the bidder to place a refund request through the relevant dashboard/wallet.
3. If No One Bids
An auction may fail because there are no bids or because the bids don't meet the applicable conditions. MSTC's guidance notes that an auction can be considered unsuccessful when nobody submits a bid or when the highest bid is below the reserve price, after which re-auctioning may be arranged.
4. The Vehicle May Be Re-Auctioned
If an auction doesn't result in a sale, the bank may conduct another auction. The new auction can have a different date, reserve price or other terms, depending on the seller's decision.
5. What If You Were the Successful Bidder?
This is different from simply being an unsuccessful bidder. If the seller cancels or withdraws the auction after a successful bid, the applicable auction terms determine what happens to amounts already paid. MSTC's buyer terms, for example, provide for refund of the value paid for an auction item in certain seller-initiated cancellation or withdrawal situations.
Simple Example
Suppose you paid ₹40,000 EMD for a bank bike auction.
Auction cancelled before sale → Check the notice's refund procedure
You were unsuccessful → EMD is generally refundable under the applicable terms
Auction re-scheduled → Check the new auction notice
Seller withdraws an item → Follow the specific cancellation/refund conditions
Final Tip
Don't assume that every cancelled auction follows the same refund process. Read the specific auction notice carefully, especially the clauses covering cancellation, EMD refund, postponement and re-auction.
